At Generation: You Employed (HK) Limited (“we”, “us” or “GENERATION HONG KONG”),we are committed to the protection of your personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) (“PDPO”). The following privacy policy governs how GENERATION HONG KONG collects, uses, discloses, and safeguards your personal information. You may also refer to the Privacy Policy and Terms of Use of our affiliate Generation: You Employed, Inc. We may update this notice from time to time to reflect changes in our data processing practices. Please check this page periodically for any updates. If changes to this privacy policy materially affect the processing of your personal data, we will endeavor to communicate these changes to you in a way that we would normally communicate with you (e.g. via e-mail) in a reasonable period prior to implementing the changes, and obtain your consent where required under the PDPO. Types of Personal Data We Collect

We may collect personal data and other information about you depending on our engagement with you. This may include, but is not limited to:

(i) identification information such as your first name, surname, phone number, email address, date of birth, location, address, gender, race/ethnicity, social media account information, and passwords;

(ii) financial information such as your credit card details, banking details, payment information, financial situation, and tax identification numbers;

(iii) medical and health information such as your medical history, physical and mental wellbeing (such as your future outlook and confidence), disabilities, conditions, symptoms, diagnoses, test results, treatments and medications;

(iv) employment information such as your employment history, referral source, references, work authorization, work experience, employer information, job position, job satisfaction, career information, educational and other qualifications, criminal history, and any information you might include in your resume/curriculum vitae or cover letter;

(v) browsing information such as your device, IP address, browser type, geographical location and operating system, and your browsing behavior and preferences when you access or browse our platforms or those of our Generation affiliated entities such as GYE (“Affiliates”), including websites and mobile, web and desktop applications (each a “Platform”, andcollectively, “our Platforms”);

(vi) any information you may disclose to us in our post-program or alumni surveys; and

(vii) information such as your attendance at our programs, your feedback on our programs as well as any comments and opinions on blogs and forums, and profile pictures on our Platforms.

If you provide the personal data of another person to us, you confirm that you have obtained that person’s consent to provide their personal data to us for the purposes stated in this Privacy Policy.

Purposes of Collection of Personal Data

All personal data collected will be used solely for one or more of the following purposes (or any directly related purpose):

(i) to identify and verify your identity, and to create and manage your personal account for access to our Platforms;

(ii) to provide our skills training and career-support services and programs to you, such as the Gen Recruiting platform or the Learner Portal as well as those of our Affiliates;

(iii) to manage our operations and effectively respond to your messages, comments and enquiries;

(iv) to assess your eligibility for our or our Affiliates’ programs;

(v) to assess your improvement, and track your progress and changes in outlook, throughout the duration of a program so that we can provide you with suitable support and mentorship, and enhance your overall experience and success in the program;

(vi) to assess your wellbeing post-program;

(vii) to estimate the success of our or our Affiliates’ programs (including durability and sustainability of the impact) and to improve our and our Affiliates’ services and programs as well as to develop new programs;

(viii) (if you are seeking employment with us) to provide you employment or related services, including to organize interviews, tests, assessments, etc. and to include you in our talent pool for future employment opportunities;

(ix) (if you are a donor) to receive, process and record your donations;

(x) for data or statistical analysis purposes;

(xi) subject to your consent, for direct marketing purposes as detailed below;

(xii) to process your financial transactions with us or our Affiliates;

(xiii) to communicate with service providers and vendors; and

(xiv) to defend legal or other proceedings, or a dispute relating to your application (such as in connection with a possible rejection of your application);

(xv) to comply with legal obligations, applicable laws, regulations or court orders to which we or our Affiliates are subject or with which we are expected to comply;

(xvi) to comply with any reasonable request from competent law enforcement agencies or representatives, judicial authorities, regulatory authorities, governmental agencies or bodies, including competent data protection authorities;

(xvii) to inform any third party in the context of a possible merger with, acquisition from/by or demerger by that third party; and

(xviii) any other purposes as may be agreed between you and us.

Personal data may also be collected, used or otherwise processed for one or more of the purposes set out in the Privacy Policy of our affiliate GYE (available at https://www.generation.org/privacy-policy/).

For some activities, GYE will act as the data user of your personal data, and GENERATION HONG KONG will collect the data on the basis of instructions of GYE as a processor. While GENERATION HONG KONG participates in collecting data to assess the eligibility criteria of learners (pre-program), to assess how the program and mentorship services helped improve learner wellbeing (in-program) and the data collection through the Alumni survey (post-program), these activities are led by GYE. Both GYE and GENERATION HONG KONG may act as data users for other activities.

Transfer of Personal Data

We may disclose and transfer your personal data within or outside Hong Kong, for the purposes stated above, to:

(i) GYE (most of the personal data pre-program, in-program and post-program collected by GENERATION HONG KONG is stored and managed on IT programs and systems owned by GYE);

(ii) any of our employer partners who may seek to interview or employ you upon or after completion of our or our Affiliates’ programs for work placement purposes;

(iii) any of our donors;

(iv) any of our service providers and/or sub-contractors providing services such as hosting, providing analytics, performing research, undergoing development of the services, processing payments for donations, and engaging in social media services;

(v) social networking sites or job marketplaces, such as LinkedIn or JobsDB (you can find more information on how these social media providers process your personal data in their respective privacy policies); and

(vi) any regulatory authority or organization to comply with legal obligations, applicable laws, regulations or court orders to which we or our Affiliates are subject or with which we are expected to comply;

(vii) to any competent law enforcement agencies or representatives, judicial authorities, regulatory authorities, governmental agencies or bodies, including competent data protection authorities to comply with their reasonable request;

Retention and Security of Personal Data

Retention of personal data

Subject to any legal and/or regulatory requirements, we will only retain personal data for as long as necessary for the fulfilment of the relevant purposes (including any directly related purpose) mentioned above in accordance with our record retention policy.

Security of personal data

We will take all practicable steps to ensure that the personal data is protected against unauthorized or accidental access, processing, erasure, loss or use. However, the transmission of information via the internet is always subject to security vulnerabilities and we cannot guarantee the security of your personal information transmitted on our Platforms.

Where we have given you (or where you have chosen) a password for access to certain parts of our Platforms, you are responsible for keeping this password confidential. Please do not share your password with anyone.

Access and Correction of Personal Data

Under the PDPO, you have the right to access your personal data, meaning that you can ask us to provide you with information regarding personal data we have about you or ask for a copy ofyour personal data. We may charge a fee for complying with your requests as permitted by the PDPO. We may also refuse your requests where permitted by the PDPO.

Under the PDPO, you also have the right to correct any personal data related to you held by us if it is incorrect.

If you would like to exercise any of the above rights, please send us a written request by email (hkprivacy@generation.org), clearly stating which right you wish to exercise and indicating the context in which we obtained your personal data so that we may handle your request swiftly and diligently.

Use of Personal Data in Direct Marketing

Provided you have consented to such use, we may use personal data (including your name, role and contact information) for direct marketing communications (including by email, SMS, instant messaging services or Platform notifications) in relation to the training and career-support services and programs of GENERATION HONG KONG and those of our Affiliates (including the latest course or event information and promotional materials), and other related promotional programs and offers, and fundraising activities.

Cookies

“Cookies” are small text files stored by your browser on your device when you visit our Platforms. We use cookies and similar technologies to collect non-identifiable data to enhance user experience, analyze visitor traffic and for other related purposes. By accessing our Platforms, you consent to our use of cookies. You can manage your cookie preferences by adjusting your browser settings.
